Protecting Injured Employees

Lost Wages. Mounting Bills. Injured at Work? We Can Help.
No matter where you work—whether it’s a construction site or an office—accidents and injuries can happen. That’s why workers’ compensation insurance exists: to protect employees who suffer workplace injuries that prevent them from earning a living.

Understanding Workers’ Compensation Benefits

Under South Carolina’s Workers’ Compensation Statute, injured employees are entitled to specific benefits based on the nature and extent of their disability:

Total Disability:
If an injury results in total incapacity for work, the employer is required to provide weekly compensation equal to 66 2/3% of the employee’s average weekly wages, with a minimum of $75 per week, provided this amount does not exceed the employee’s average weekly salary.

Permanent Disability:
The loss of both hands, arms, shoulders, feet, legs, hips, vision in both eyes, or any two of these, is classified as total and permanent disability under the statute. Compensation is calculated based on the statute’s guidelines for such cases.

Partial Disability:
When an injury results in partial incapacity for work, the employer must compensate the injured employee with 66 2/3% of the difference between their average weekly wages before the injury and the wages they can earn afterward. This compensation is capped at the average weekly wage in the state for the preceding fiscal year.

Navigating the workers’ compensation process can be overwhelming, especially when dealing with insurance companies that may not have your best interests in mind. Let DuRant Law guide you through every step, ensuring you receive the benefits and support you’re entitled to under the law.
